Terms & Conditions
1. General:
The booking contract is between the hirer and the owner of the property for which the booking is made and incorporates the conditions set out below.The price includes reasonable use of utilities but NOT pool heating, hot tub/spa heating, flights, car hire, holiday insurance etc.
2. Authority to sign:
The person who signs the booking form certifies that he or she is authorized to agree to Booking Conditions on behalf of all persons included on the Booking Form .The signatory must be a member of the party occupying the property and must be 21 years or over.
3. Deposit and Payment Balance:
A non-refundable deposit of 20% must accompany the signed booking sheet. The balance of payment (80%) must be received in full at least 10 weeks prior to the commencement of the holiday. If the booking is made within 10 weeks of the commencement date then full payment must accompany the booking. We reserve the right to cancel the booking if the payments are not received by the due date; cancellation charges will apply as set out in the next section.
4. Booking Cancellations:
Cancellation must be in writing by the party leader. In the event of cancellation, the following charges apply: 10 weeks or more prior to rental period - loss of deposit only, less than 10 weeks - 100% Rental Charge. For most reasons beyond your control cancellations will be covered by your Travel insurance.YOU ARE AGAIN REMINDED OF THE ADVISABILITY OF TAKING OUT ADEQUATE TRAVEL INSURANCE FOR ALL MEMBERS OF YOUR PARTY.
5. Refundable Security Deposit:
Upon signing the rental agreement the signatory agrees to pay for any damage of any kind to the property from the security deposit. A refundable security deposit of £250/$400 must be paid along with your final balance by you regardless of the length of your stay. This is to guard against any possible damage / loss / excessive cleaning to the property that is incurred during your rental period.
6. Arrivals and Departures:
The house will be available for occupancy from 4:00pm on the day or arrival and must be vacated by 11:00am (prompt on day of departure).
7.Animals and Pets:
Animals/pets are strictly not permitted. If a pet has been in a home, there will be an automatic charge at the owner's discretion, to cover the cost of professionally cleaning all carpets and upholstery and to call in a pest control agency.
8. Pool Heating:
Pool heating should be requested at the time of booking (recommended November-March). There is an additional charge and this must be paid for within the final balance. In the event pool heating is requested and paid for, the owners cannot guarantee the temperature of the pool as this will vary according to different factors, predominantly the weather conditions at the time. The owner or owner's agent will not be held responsible for any electrical or mechanical failure of pool heating equipment. In this event a full refund of the pool heat charge will be administered. The pool covers must be used to retain the heat when the pool is not in use and this is the responsibility of the guest at the time. Please see the rental rates for pool heat charges.
9. Party Size:
Everyone occupying the house, including ages, must be listed on the booking form, this includes small children. This is Florida State law and must be adhered to. The accommodation cannot be shared; assigned or sub-let and only persons shown on the booking form are permitted to stay in the property. Persons under 25 years of age are not acceptable unless accompanied by parents or responsible adults. This property is fully licensed for short-term rental in Florida. The Owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.
10. Smoking:
For the safety and comfort of all our guests smoking is not permitted within any of the properties. Thank-you.
11. Liability:
The
Owners and Management Company of the property accept no responsibility
whatsoever for the death, personal injury, accidents, loss, or damage
to persons or personal belongings however caused. The use of all
accommodations and all amenities, including the swimming pool is
entirely at the users own risk. Children must al all times be supervised
by responsible adults when using the swimming pool and at no time
at all are the pool and deck doors' alarms to be tampered with.
GLASS is not permitted within the pool area. The Owners and Management
Company cannot accept any liability for any loss of rental time
due to travel problems, flight delays, cancellations, terrorist
acts, industrial disputes or any events, which are outside our control,
including any form of Force Majeure.
12. Force Majeure:
As with any other holiday, there may be circumstances completely beyond our control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include (but no limited to) destruction of or severe damage to the property. Such circumstances are referred to as "Force Majeure". In the event of Force Majeure the owners will do their best to make alternative arrangements for you where possible. If they cannot, or if alternative arrangements are unacceptable to you, then they will refund all monies paid. This will be the full extent of the owner's liability to you in such circumstances, and they shall not be responsible for any other costs connected with any such cancellation, however arising.
13. Responsibilities:
The guests are responsible for the property, and are expected to take all reasonable care of it including the locking of all doors and windows and ensuring the security alarm is activated whenever the house is unoccupied. At the end of the rental period, all equipment including everything in the house all walls, carpets and furnishings must be left clean and tidy.
14. Code of Conduct:
All clients undertake to behave with propriety and in such a manner as in no way to cause or be likely to cause damage, distress danger or annoyance to other clients, property and/or any third party. The contract of any client in breach of this clause will be terminated and neither we nor the providers of the services in question will have any further contractual obligations to you.15. Law:This contact is subject to and shall be construed in accordance with the laws of Great Britain and all parties hereby submit to the exclusive jurisdiction of the British Courts.
16. Owners Access:
The Owners or their Management Company shall be allowed access at any reasonable time during your stay.
17. Complaint procedures:
On very infrequent occasions you may feel inclined to register a complaint. We try our up most to ensure your stay is problem free and we take very seriously levels of service and accommodation which are deemed to be substandard. Please contact the owners at your earliest convenience so that the situation can be resolved as quick as possible. If this complaint relates to services provided, then it is incumbent upon you to seek a resolution while you are still in occupation of the accommodation we have arranged. If the problem relates to the accommodation or other on-site services, it must be reported to the local management company responsible at your location in accordance with the instructions with which you will have been provided. If you fail to register the complaint immediately, your omission will be regarded as a breach of the contract between you and Farnworth Property Trust LLC, who will not then assume responsibility. If however, you follow the required procedure with the local management company, but fail to achieve satisfaction then you must register your complaint with Farnworth Property Trust LLC in writing and within 7 days of your return home.
